Terms of Service

By accessing or using Image 2.6 ("the Platform"), operated by Image 2.6, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

Image 2.6 is an independent website that generates images from your prompts. Requests are run on GPT Image 2.6 through third-party AI model infrastructure providers.

Image 2.6 is not an official OpenAI product. It is not operated, sponsored or endorsed by OpenAI and has no affiliation with OpenAI. OpenAI, ChatGPT and GPT-Image are the property of their respective owners and are named here only to describe the model the Platform uses. An account on Image 2.6 is separate from any OpenAI or ChatGPT account.

You must be at least 13 years old to use Image 2.6. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Generating images requires an account, which you create by signing in with Google. You are responsible for keeping access to your account secure and for all activity that occurs under it.

We reserve the right to suspend or terminate accounts that contain inaccurate or fraudulent information.

Generating an image spends credits. An image costs at least 5 credits depending on the quality you choose, and the generate button shows the cost before you start. New accounts receive 3 credits, which is not enough for an image on its own.

You can buy credits through a monthly plan, a yearly plan or a one-time credit pack. Fees are charged in advance, and payments are processed by Waffo.

- Monthly plans add their credits at the start of each billing cycle. Yearly plans add the full year of credits at the start of the plan year.

- Plan credits expire at the end of the billing period and do not roll over.

- Credit packs remain valid for 365 days from purchase.

- Credits are non-transferable, have no cash value and cannot be exchanged for money, except as stated in the Refund Policy.

If a generation fails on our side, its credits return to your balance automatically. A request stopped by our content check is not charged.

You may cancel a plan at any time from the billing portal on the Billing page of your account. Cancellation takes effect at the end of the current billing period, and you keep access to your plan until then. Refunds are covered by our Refund Policy.

You agree to use the Platform only for lawful purposes and in accordance with these Terms. These limits apply to your prompts and to any reference images you submit. You may not use the Platform to create:

- Pornography, nudity, or any other sexual or adult content.

- Any sexual or sexualized content involving minors, whether photographic, drawn or computer-generated. We may report such content to the authorities.

- Face swaps and deepfakes: placing a real person's face on another body or image, or creating a realistic fake image of a real person.

- The likeness of a real, identifiable person without that person's consent, including public figures.

- Content that is illegal, harmful, threatening, abusive, defamatory or that infringes the rights of others.

You also may not:

- Try to get around the content check, for example by rewording a blocked request to obtain the same result.

- Attempt to reverse-engineer, decompile or extract source code from the Platform.

- Use automated scripts, bots or scrapers to access the Platform beyond normal usage.

- Interfere with or disrupt the Platform's infrastructure or other users' experience.

Before generation, an automated check stops prompts that ask for adult content or sexualized depictions of minors, prompts that name a real person, and reference images that show nudity, sexual activity or a sexualized minor. The upstream model provider applies its own safety rules. Either may refuse a request, and a refused request is not charged.

The automated check can make mistakes, and it cannot reliably recognize a real person in a reference image. These limits apply whether or not the check catches a request, and you are responsible for what you submit.

If you break these limits, we may refuse your requests and suspend or terminate your account without notice, and any remaining credits are forfeited as described in Section 11.

The website design, logos and software of the Platform are owned by Image 2.6 or its licensors and are protected by applicable intellectual property laws. The image model belongs to its owner.

Image 2.6 does not claim ownership of the images you generate and does not limit their use by plan. You are responsible for how you use them, including checking that a use is lawful and does not infringe the rights of others. Similar prompts can produce similar results, and we do not promise that an image is unique or qualifies for copyright protection.

By submitting text, images or other input to the Platform, you confirm that you have the right to do so, and you grant Image 2.6 and the providers that process your request a non-exclusive, royalty-free license to process that input solely for the purpose of producing your requested output.

If you submit feedback, suggestions, or other content to Image 2.6 (for example by email), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and incorporate those contributions to improve the Platform.

You represent that any content you submit does not infringe on the rights of any third party.

The Platform and all content generated through it are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Generated images may be inaccurate or may not meet your expectations. Results vary with your prompt and settings, and we do not guarantee specific outcomes. The Platform depends on third-party services, and the model may change or become unavailable because of its providers.

To the fullest extent permitted by law, Image 2.6 and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Platform.

Our total liability for any claim arising from these Terms or the Platform shall not exceed the amount you paid to Image 2.6 in the twelve (12) months preceding the claim.

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, without notice, if you violate these Terms or engage in activities that harm the Platform, other users, or our reputation.

Upon termination, your right to use the Platform ceases immediately. Any credits remaining in your account at the time of termination are forfeited.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the operator of the Platform is established, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the competent courts of that jurisdiction.
